2. Terms of site usage
While we have made every attempt to ensure that the information contained in this site is reliable and accurate, Emma Harris is not responsible for any errors or omissions, or for the results obtained from the use of this information. All information in this site is provided ‘as is’, with no guarantee of completeness, accuracy, timeliness or of the results obtained from the use of this information, and without warranty of any kind, express or implied, including, but not limited to warranties of performance and fitness for a particular purpose. In no event will Emma Harris, the agents or employees thereof be liable to you or anyone else for any decision made or action taken in reliance on the information in this site or for any consequential, special or similar damages, even if advised of the possibility of such damages.
Certain links in this site connect to other websites maintained by third parties over whom Emma Harris has no control. Emma Harris makes no representations as to the accuracy or any other aspect of information contained in other websites. Your dealings with persons found via the site are between you and such persons and we will not be liable for any loss or damage arising out of such dealings.
3. General
These Terms + Conditions are the only conditions under which we are willing to sell the goods provided by Emma Harris to you. These conditions can only be modified as set out in these conditions or by a variation in writing signed by a director of Emma Harris. Nothing in these Terms + Conditions shall detract from your statutory rights.
We reserve the right to vary or amend these conditions from time to time. We will post a copy of the revised conditions on this site. The conditions in force at the time we agree to sell goods to you will apply to the contract between us for the sale of such goods.
4. Product specification
Whilst we have taken great care to ensure the images and descriptions on this website are as accurate as possible slight variations in goods may occur. We will make every effort to supply the goods as advertised but reserve the right to supply the goods subject to minor variations in actual specifications without prior notice.
5. Orders and deliveries
All contracts of sale made by Emma Harris shall be deemed to incorporate these Terms + Conditions, which shall prevail over any other terms from the party (the customer) with whom Emma Harris is dealing.
Cancellation of orders by customers can only be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000.
Your submission of an order represents an offer to purchase the goods indicated by you and it is not binding on us until we have notified you that an order is accepted. All orders are subject to acceptance and to availability of the goods ordered. Emma Harris is entitled to refuse any order placed by you.
We reserve the right to refuse to accept orders from customers outside of the United Kingdom or to charge for any additional postage charges incurred by us in sending goods outside of the United Kingdom. Customers outside the United Kingdom are responsible for paying any local import taxes and other such costs. In the event that customs officials open and check the contents of your package it is possible that the wrapping may be removed or altered. Emma Harris cannot be held liable in this regard.
Where we hold stock, we will endeavour to despatch any goods we have agreed to sell to you within two working days of the date of acceptance of your order (working days mean Monday to Friday, excluding Bank or other Public holidays). Any time or date stated for delivery is an estimate only. Emma Harris makes every effort to despatch goods on time, but does not accept liability for failure to deliver within the stated time. Where goods purchased are made to order (bespoke) or where we do not have stock of that particular item, we will endeavour to despatch goods within one week. Any such timescales will be indicated on the acceptance and confirmation of your order.
Orders that have been accepted by us will be dispatched to the address you have notified to us (see Postage + Packaging).
Delivery is deemed to take place when the goods are delivered to the customer’s nominated address, whereupon the risk of loss, breakage and all damage and all other risks shall pass to the customer.
6. Price and payment
The price for the goods is as listed on the site at the date you place an order.
All prices are inclusive of VAT at the current rates and are correct at the time of entering information. Emma Harris reserves the right to change prices without prior notice.
Payment can be made by major credit or debit card. Payment will be debited and cleared from your account before the despatch of your goods to you.
You undertake that all details you provide to us for the purpose of purchasing goods or services offered on our site are correct and the credit or debit card you use to make a purchase from us is your own card, that you are authorised to use it, and that there are sufficient funds or credit facilities to cover the cost of any goods or services you order from us.
All credit/debit card holders are subject to validation checks and authorisation by the card issuer and we may share your personal information with such parties as are necessary to enable us to do such checks. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
Emma Harris have selected SagePay UK and PayPal, to process our debit and credit card transactions. The transfer of the purchase details from this site to PayPal are encapsulated using PayPal’s encrypted and digitally-signed protocol. Communication between the customer and PayPal is also encrypted to the maximum strength supported by the customer’s browser using 128 Bit SSL.
7. Returns and refunds
We always endeavour to supply quality goods. However, if you find that any goods are damaged or faulty then please return them to us in their original packaging and wrapping, unworn and in the condition they were received within 14 days of delivery. Emma Harris does not accept liability for fault or damage to deliveries unless the customer notifies Emma Harris of the damage or fault in writing to info@emma-harris.co.uk within 7 days of receipt of the delivery. Similarly, should you wish to cancel your order for any other reason, please do so in writing within 7 days of delivery and return the goods in their original packaging and wrapping in the condition they were received by registered or recorded post within 10 days of delivery.
Please specify the reason for the return. On receipt of such returned goods we will as agreed between us either: issue replacement goods and refund your reasonable postage costs in returning the damaged or faulty goods; or refund the value of the goods in full together with your reasonable postage costs in returning the damaged or faulty goods.
If you have requested a refund, or replacements of a lower value than the returned goods, any refund due will be credited back to the card used to pay for the original order. We will let you know as soon as the refund has been processed. Please note that we are unable to offer credit notes.
It is your responsibility to take good and proper care of any goods that are to be returned whilst in your possession and to ensure that they are not worn, altered or damaged. We reserve the right to refuse to accept returns of any goods that do not comply with this clause.
Contracts for the purchase of goods by a customer through this site are subject to The Consumer Protection (Distance Selling) Regulations 2000.
8. Privacy policy
We will request certain personal information from you in order to process orders received from you. You are responsible for the accuracy and truthfulness of such information and you warrant and undertake to us that all such information is true and correct.
We will use your personal information for the purposes of processing orders from you. We will treat your personal information as confidential and we will not disclose it to any third party except with your prior agreement or where it is absolutely necessary for the purposes of processing your order or as required by law. Your data will be processed subject to the Data Protection Act 1998 and we have procedures in place to protect its security.
We may use your personal information from time to time to contact you about our products and services that might be of interest to you. If you do not wish to receive such communications please notify info@emma-harris.com.
By accessing the site and by placing orders for goods you agree to our terms for the collection and use of your personal information.
9. Copyright and trademarks
All material on this site is the copyright material of Emma Harris. All rights are reserved. The copying or adaptation of the material on this site or its incorporation into any other work by any means is prohibited, except that you may print or download extracts of such material for your personal use. You are not granted any other rights in respect of copyrighted material.
All trade marks and trading names on this site are the property of Emma Harris and may not be used, reproduced, published, uploaded, posted, modified or transmitted in any way (other than for viewing the site or ordering goods) except with our prior written consent.
10. Events beyond our control
We will not be liable if we are unable to perform our obligations under these Terms + Conditions arising from acts, events, omissions, happenings or non-happenings beyond our reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.
11. Law and liability
These terms and conditions are subject to English law and you and we submit to the exclusive jurisdiction of the English courts.
Emma Harris’s liability in respect of all losses shall be limited to the invoiced amount of the relevant order, provided it has been paid.
Emma Harris confirms that the goods it supplies do not present a hazard to health and safety when properly used for the purpose for which they are designed; and if the Customer takes reasonable and normal precautions in their use.
If any part of these Terms + Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Terms + Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms + Conditions.
